The Terms of Use and Privacy Policy (“TOU”) governs your use of the DC Special Effects (“DCFX”) website (“Site”). Any use by you of the site is subject to these terms, and constitutes acceptance by you of the then-current TOU.

The material on the Site is owned by DCFX and/or other copyright holders, including (but not limited to) studios, producers, and others for whom DCFX has provided services. 

You are not permitted to use any part of the content of the Site by any means and for any purpose other than viewing on the internet.  For the avoidance of doubt, downloading and/or storage (other than temporarily and purely incidental to web browsing or for temporary personal use) of material from the Site is prohibited.  Material from this Site which is owned by people other than DCFX (such as, but not limited to video clips) may not be used without the separate permission of the owners of that material.

Where the Site provides links to other sites, DCFX does so purely as a convenience to you. DCFX accepts no responsibility for the content or conduct of the other sites to which we provide links.

Disputes and Law

This Site is operated in New Zealand by DCFX, which is a New Zealand company.  Any disputes or claims arising from or relating to your use of the Site will be heard only in the Courts of New Zealand, and you hereby agree to the jurisdiction of the New Zealand Courts to hear any such dispute.

Disclaimer of Warranties and Limitations of Liability

The Site, including without limitation all material and information on the Site, are provided “as is” and entirely without warranty by DCFX.  Your use of the Site is entirely at your own risk.  You agree that you shall not make any claim against DCFX for any material on the Site; that in no event will DCFX be liable for any special, indirect, consequential, or other damages; and that, in any case or circumstance, DCFX’s liability to you will not exceed one dollar.

Privacy – Introduction

In this TOU when we use the term “Personal Information”, it means any information from which your identity is apparent or can be reasonably ascertained.  For most users, DCFX does not collect any Personal Information. In all cases, we collect Personal Information only by explicitly asking for it on a web form.  (The exception is for “session cookies”, which are used to track a visitor only during a single visit to this site.)

Use and Disclosure of Information

You agree to indemnify, defend and hold DCFX (including DCFX’s officers, directors, agents, and shareholders) harmless from and against any and all loss, costs, expenses, claims, damages and liabilities related to or associated with your use of this Site.

We will only use or disclose Personal Information that you have provided to us or information generated by cookies if:

  • you have authorised us to do so;
  • we have given you notification of the intended use or disclosure and you have not objected to that use or disclosure;

We do not sell or trade Personal Information. We retain Personal Information for an indefinite period.

Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Accordingly, although DCFX strives to protect such information, DCFX cannot ensure or warrant the security of any information you transmit to us or from our online services and you do so at your own risk.
